1. About These Terms

These Terms & Conditions ("Terms") govern your use of the You& platform ("You&", "the platform", "the app"), operated by 8.13 Elevata, based in Australia.

By creating an account and using You&, you agree to these Terms in full. If you do not agree, please do not use the platform.

2. Who Can Use You&

You may use You& if you:

  • Are aged 18 or over
  • Are a founder, leader, or professional seeking a thinking partner
  • Provide accurate information when creating your account
  • Are not prohibited from using the platform under applicable law

We reserve the right to refuse access to anyone at our discretion.

3. Your Account

Creating an account

You must provide a valid email address and name to create an account. You are responsible for keeping your login credentials secure and for all activity that occurs under your account.

Accuracy of information

You agree to provide truthful and accurate information during onboarding, including your quiz responses and personal message. Misrepresenting yourself to influence the matching algorithm is a breach of these Terms.

One account per person

You may only create one account. Creating multiple accounts to game the matching system is not permitted.

4. The Matching Service

You& uses a personality quiz and message embedding algorithm to match you with another user. By completing onboarding, you understand and agree that:

  • Matches are determined algorithmically and are not guaranteed to be suitable for every user
  • We do not guarantee a match will be found within any specific timeframe
  • We do not guarantee the accuracy, quality, or outcome of any conversation or connection made through the platform
  • You& is a tool to facilitate connection — we are not responsible for the outcomes of conversations or relationships formed through the platform

5. Conversations and Content

Your content

You retain ownership of any content you submit to You&, including your personal message, intro, and conversation messages. By submitting content, you grant 8.13 Elevata a limited, non-exclusive licence to store and process that content solely to operate the platform (including generating embeddings for matching purposes).

Content standards

You agree not to use You& to send or post content that:

  • Is abusive, threatening, harassing, defamatory, or discriminatory
  • Is sexually explicit or inappropriate
  • Promotes illegal activity
  • Contains spam, advertising, or unsolicited commercial messages
  • Infringes the intellectual property rights of any third party
  • Is false, misleading, or designed to deceive another user

Moderation

We reserve the right to remove any content that violates these standards and to suspend or terminate accounts that repeatedly breach them.

6. Acceptable Use

You agree not to:

  • Use You& for any unlawful purpose
  • Attempt to access another user's account or data
  • Reverse engineer, scrape, or copy any part of the platform
  • Use automated tools or bots to interact with the platform
  • Attempt to disrupt or overload the platform's infrastructure
  • Impersonate another person or misrepresent your identity
  • Use the platform to harass, stalk, or harm another user

7. User Safety

You& connects strangers online. While we use algorithmic matching to find compatible users, we cannot verify the identity or intentions of every user. You are responsible for your own safety when interacting with matched users.

You should:

  • Never share sensitive personal information (home address, financial details, government ID) in conversations
  • Trust your instincts — if a conversation feels uncomfortable, you can stop at any time
  • Report any concerning behaviour to us at team@813elevata.com

We take reports of harmful behaviour seriously and will investigate promptly.

8. Intellectual Property

All content, design, code, and branding on You& (excluding user-submitted content) is owned by 8.13 Elevata or its licensors and is protected by Australian and international intellectual property laws.

You may not copy, reproduce, distribute, or create derivative works from any part of the platform without our prior written consent.

9. Third-Party Services

You& uses third-party services to operate, including OpenAI (message embedding), Resend (email delivery), and Lovable Cloud / Supabase (infrastructure). Your use of You& is also subject to the terms of these third-party providers where applicable.

We are not responsible for the availability, performance, or practices of third-party services.

10. Disclaimers

You& is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by Australian law, we disclaim all warranties including:

  • That the platform will be uninterrupted, error-free, or secure
  • That matches will be accurate, compatible, or result in meaningful connections
  • That any information on the platform is complete or up to date

Nothing in these Terms excludes any guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law.

11. Limitation of Liability

To the fullest extent permitted by law, 8.13 Elevata's total liability to you for any claim arising out of or in connection with your use of You& is limited to AUD $100.

We are not liable for any indirect, incidental, special, or consequential loss or damage, including loss of data, loss of revenue, or damage to reputation, even if we have been advised of the possibility of such loss.

Nothing in these Terms limits our liability for fraud, death, or personal injury caused by our negligence.

12. Termination

By you

You may delete your account at any time by contacting team@813elevata.com. Upon deletion, your data will be removed in accordance with our Privacy Policy.

By us

We reserve the right to suspend or terminate your account at any time if you breach these Terms, without notice and without liability to you.

Upon termination, your right to use the platform ceases immediately.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email and update the "Last updated" date above. Your continued use of You& after changes are notified constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of You& will be subject to the exclusive jurisdiction of the courts of New South Wales.
